Customer data is hosted in a European Union region. The conditions under which certain technical resources are administered outside the European Union, together with the safeguards framing those transfers, are described in article 11 of the Privacy Policy and article 12 of the DPA.

4. Access to and use of the Service

Access to and use of the AI4PLAN SaaS software are governed by:

• the Terms and Conditions of Sale (T&Cs),
• the Terms of Use (ToU),
• the Data Processing Agreement (DPA),
• the Service Level Agreement (SLA),
• the Privacy Policy.

In the event of conflict, the order of precedence is that set out in article 1 of the T&Cs: the T&Cs, then any special conditions agreed in writing between the parties, then the DPA, then the ToU, then the SLA.

5. Intellectual property

AI4PLAN SAS is the exclusive owner:

• of the software, the processing and analysis algorithms, the databases,
• of all content, visuals, interfaces and texts.

Any reproduction, adaptation, extraction, representation, distribution or exploitation is prohibited.

The databases are protected by the sui generis right (French Intellectual Property Code).

6. Personal data

AI4PLAN processes data in accordance with:

• the GDPR,
• the Privacy Policy,
• the DPA entered into with the Customer.

Controller:

• AI4PLAN for commercial, technical and support data.
• The Customer for data imported into the Service.

International transfers: permitted only with safeguards (standard contractual clauses, adequacy decision, technical measures).

7. Processors

AI4PLAN uses processors falling within the following categories:

• cloud hosting,
• monitoring and supervision,
• support,
• transactional emailing,
• IT security,
• backup and archiving,
• management of the institutional website and appointment booking,
• conversational agent,
• customer relationship management and payment service providers.

The detailed list is available on request. As regards processors involved in data processed on behalf of the Customer, it is communicated on the terms of article 7 of the DPA.

8. Liability

AI4PLAN does not warrant:

• the accuracy of the Outputs,
• the permanence or accuracy of the information on the institutional website,
• perpetual compatibility with all third-party formats.

All limits set out in the T&Cs apply.

Human verification of the Outputs is mandatory.

9. Cookies and similar technologies

The Site and the Service use only cookies and local storage mechanisms strictly necessary to their operation: session maintenance, securing of access, storage of interface preferences and operation of the conversational agent.

No audience measurement, advertising or behavioural tracking cookie is used.

Details are provided in article 12 of the Privacy Policy.

10. Reporting of unlawful content

Any person may report unlawful content in accordance with article 6.I.5 of the French Act on Confidence in the Digital Economy (LCEN).

Mandatory notification comprising:

• surname, first name, address,
• description and legal ground,
• URL of the disputed content,
• copy of the content reported.

11. External links

Hypertext links pointing to the public pages of the Site are free, provided that they do not mislead as to the origin or affiliation of the linked content, and that they do not prejudice AI4PLAN’s rights or image.

AI4PLAN may request the removal of a link that does not comply with these conditions.

AI4PLAN exercises no control over third-party sites to which the Site may refer and disclaims all liability as to their content.

12. Governing law

The AI4PLAN site and service are subject to French law.

The competent courts are those provided for in the T&Cs.
